DECISION & ORDER ON MOTION

Appeal from an order of the Supreme Court, Kings County, dated February 4, 2022. Motion by the appellant's assigned counsel, inter alia, to abate the appeal on the ground that it has been rendered academic by the appellant's death on September 18, 2024.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is granted to the extent that the appeal is dismissed as academic, without costs or disbursements; and it is further,

ORDERED that the motion is otherwise denied.
