People of the State of New York, respondent,
v Corey Fitzgerald, appellant.
Appeal from a judgment of the Supreme Court, Queens County, rendered November 6, 2025. Motion by the appellant, in effect, pursuant to CPL 460.30 to deem the notice of appeal from the judgment to be timely filed and to deem the notice of appeal to reflect that an appeal is also taken from a purported order of the same court dated November 6, 2024.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the branch of the motion which is, in effect, to deem the notice of appeal from the judgment to be timely filed is denied as unnecessary as the notice of appeal was timely filed; and it is further,
ORDERED that the branch of the motion which is, in effect, to deem the notice of appeal to reflect that an appeal is also taken from a purported order of the same court dated November 6, 2024, is denied with leave to renew upon proper papers, including a copy of the purported order.
