2024-04468 Whole House Contracting Inc., et al., respondents, v 36 Post Fields LLC, et al., appellants. (Index No. 601817/2020)
| DECISION & ORDER ON MOTION |
Appeal from a decision and order (one paper) of the Supreme Court, Suffolk County, dated April 5, 2024. By order to show cause dated October 6, 2025, the parties to the appeal were directed to show cause before this Court why the appeal in the above-entitled action should or should not be dismissed on the ground that no appeal lies as of right from an order that is not the result of a motion made on notice and/or that no appeal lies from a decision
Now, upon the order to show cause and the papers filed in response thereto, it is
ORDERED that the motion is granted, and the appeal is dismissed, without costs or disbursements (see CPLR 5701; Schicchi v J.A. Green Constr. Co., 100 AD2d 509).
