DECISION & ORDER ON MOTION

Motion by appellant for an extension of time to perfect an appeal from a decision of the Justice Court of the Town of Ramapo, Rockland County, dated November 3, 2023. Separate motion by respondent to dismiss the appeal and vacate the stay.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the motions are consolidated for disposition; and it is further,
ORDERED that the motion to dismiss and vacate the stay is denied; and it is further,
ORDERED that the motion to extend the time to perfect the appeal is granted and appellant shall perfect the appeal on or before February 26, 2026; and it is further,
ORDERED that in the event the appeal is not perfected by February 26, 2026, on its own motion, may dismiss the appeal, or respondent may move, on three days' notice, to dismiss the appeal, and may, if appellant is unrepresented, serve such application upon appellant in person.
The court notes that regardless of whether the presiding judge at trial is still with the Justice Court or not, pursuant to Judiciary Law § 7-a, he may be compelled to settle the transcript, even after he leaves office.
