Appeal from an order of the Civil Court of the City of New York, Kings County, dated July 2, 2024. By decision and order of this court dated March 6, 2025, on the court's own motion, the parties to the appeal were ordered to show cause why an order should not be made pursuant to CPLR 5515 (1) dismissing the appeal for failure to serve the notice of appeal upon respondent-tenants, by filing an affidavit or affirmation on that issue with the Clerk of this court on or before April 10, 2025. Separate motion by appellant for a preference in calendaring the appeal.
Upon the order to show cause and the papers filed by appellant in response thereto, and no papers having been filed by respondents in response thereto, and upon the motion for a preference and no papers having been filed in opposition thereto, it is
ORDERED that the motion to dismiss the appeal is granted and the appeal is dismissed; and it is further,
ORDERED that the motion for a preference in calendaring the appeal is denied as moot.
