DECISION & ORDER ON MOTION
| Veronica Pierre, Respondent, v Noel Smart, Jonelle Smart and Hilda Jeffcoat, Appellants. |
Motions by appellant to consolidate appeals from the orders of the Civil Court of the City of New York, Kings County, dated June 28, 2024 (appeal No. 2025-581 K C) and August 13, 2024 (appeal No. 2025-584 K C), respectively.
Upon the papers filed in support of the motions and no papers having been filed in opposition thereto, it is
ORDERED, on the court's own motion, that the appeal from the June 28, 2024 order (2025-581 K C) is dismissed, as no appeal as of right lies from a sua sponte order (see CCA 1702 [a] [2]; Sholes v Meagher, 100 NY2d 333 [2003]); and it is further,
ORDERED, on the court's own motion, that the appeal from the August 13, 2024 order (2025-584 K C) shall be perfected on or before February 1, 2026; and it is further,
ORDERED that in the event the appeal is not perfected by February 1, 2026, the court, on its own motion, may dismiss the appeal, or respondent may move, on three days' notice, to dismiss the appeal, and may, if appellant is unrepresented, serve such motion upon appellant in person; and it is further,
ORDERED that the motions are denied as moot.
The August 13, 2024 order denied appellant's motion to vacate the June 28, 2024 sua sponte order.
