DECISION & ORDER ON MOTION

Jennifer Christie, Also Known as Jennifer Sorrento, Respondent, v John Doria and Ann Doria, Appellants.

Motions by appellants for a stay of a final judgment of the Civil Court of the City of New York, Richmond County, entered March 25, 2025, pending the determination of appeals from a decision of that court dated March 12, 2024 (docket number 2025-983 RI C) and an order of that court dated April 3, 2025 (docket number 2025-817 RI C), respectively, to waive costs, fees, and expenses, and for leave to prosecute the appeals on the original record. Separate motions by appellants to consolidate the appeals and to extend the time to perfect the appeals.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is

ORDERED that the branches of the respective motions seeking to proceed upon the original record is granted; and it is further,

ORDERED that the branches of the respective motions seeking to waive costs, fees, and expenses is granted; and it is further,

ORDERED that the court stenographer or a certified transcriber, if any, shall promptly make, certify and file two typewritten transcripts of the minutes of all proceedings, if any, with the clerk of the trial court, who is directed to furnish without charge one copy to appellants to prosecute the appeals; and it is further,

ORDERED that appellants shall serve a copy of the transcript, if any, upon respondent, same to be returned upon the argument or submission of the appeal. The minutes shall be settled in accordance with New York City Civil Court Act 1704. The clerk is further directed to file the second copy of the transcript, if any, with the record, which shall then be filed with this court; and it is further,

ORDERED that the branches of the respective motions seeking to consolidate the appeals is granted to the extent that the appellants may perfect the appeals with a single brief bearing both docket numbers and the original record on appeal and there shall be oral argument, if requested, on both appeals at the same time; and it is further,

ORDERED the branches of the respective motions seeking a stay is granted on condition that appellants pay to respondent rent and/or use and occupancy at the rate of $3,864 per month as it becomes due and file with this court proof of payment within one business day after making such payment; and it is further,

ORDERED that the branch of the respective motions seeking an extension of time to perfect the appeals is granted and the appeals shall be perfected on or before January 17, 2026; and it is further,

ORDERED that in the event the appeals are not perfected by January 17, 2026 or appellants fail to comply with the stay conditions, the court, on its own motion, may dismiss the appeals or vacate the stay, or respondent may move, on three days' notice, to dismiss the appeals or vacate the stay, and if the appellants are unrepresented, may serve such motion upon the appellants in person.
