Counsel for appellant having moved for permission to withdraw as assigned counsel on an appeal taken herein from a judgment of the Supreme Court, Erie County, rendered October 18, 2024, on the ground that the appellant has abandoned the appeal, and for alternative counsel to be assigned,
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as counsel seeks to withdraw is granted, and Lyle T. Hajdu, Esq. is relieved of his assignment, and
It is further ORDERED that the motion insofar as it seeks assignment of alternative counsel is denied, and
It is further ORDERED that the appellant perfect the appeal on or before February 6, 2026, and in the event of failure to so perfect, the appeal is hereby dismissed without further order.
