Appellant having applied for a waiver of costs, fees, and expenses and for assignment of counsel on the appeal taken herein from a judicial surrender executed and acknowledged before the Family Court, Monroe County, on October 10, 2025,
Now, upon reading and filing the papers with respect to the application, and due deliberation having been had thereon,
It is hereby ORDERED that the notice of appeal dated October 13, 2025, shall be treated as valid as to the judicial surrender executed October 10, 2025, under Family Court docket number AS-9925-25, and
It is further ORDERED that the appeal is dismissed (see Family Court Act § 1112 [a]), and
It is further ORDERED that the application is dismissed.
