DECISION & ORDER ON MOTION

Appeal from an order of the Supreme Court, Queens County, dated July 25, 2024. By decision and order on motion of this Court dated May 19, 2025, the appellant was directed to serve and file a supplemental appendix on or before June 18, 2025. Motion by the respondent, inter alia, to dismiss the appeal for failure to comply with the decision and order on motion of this Court dated May 19, 2025. Motion by the appellant, inter alia, in effect, for leave to reargue the motion which was determined by decision and order on motion of this Court dated May 19, 2025.

Upon the papers filed in support of the motion by the respondent and no papers having been filed in opposition or in relation thereto, and upon the papers filed in support of the motion by the appellant and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion by the appellant which is, in effect, for leave to reargue the motion which was determined by decision and order on motion of this Court dated May 19, 2025, is denied; and it is further,

ORDERED that the branch of the motion by the respondent which is to dismiss the appeal is granted, and the appeal is dismissed without costs or disbursements; and it is further,

ORDERED that the motions are otherwise denied as academic.
