ORDERED that the decision and order on application of this Court dated January 16, 2026, in the above-entitled case is recalled and vacated, and the following decision and order on application is substituted therefor:
Appeal from an order of the Supreme Court, Westchester County, dated July 21, 2023. Application by John R. Jones, as administrator of the estate of Catherine J. Jones-Nixon, also known as Catherine Jones, also known as Catherine Nixon, to be substituted for the deceased respondent Catherine Jones, and to amend the caption accordingly.
Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application is granted, John R. Jones, as administrator of the estate of Catherine J. Jones-Nixon, also known as Catherine Jones, also known as Catherine Nixon, is substituted for the deceased respondent Catherine Jones, and the caption is amended accordingly.
