Plaintiff having moved to strike certain portions of defendants' answering brief on the appeal taken herein from an order of the Supreme Court, Herkimer County, entered July 30, 2024,
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that the plaintiff's motion to strike that part of defendants' answering brief that is in support of their cross-appeal is granted, on the grounds that defendants' appeal was deemed dismissed due to failure to perfect on February 26, 2025 (see 22 NYCRR 1250.10 [a]).
