It is hereby ORDERED that the motion insofar as it seeks a stay of proceedings in Supreme Court is denied without prejudice to a motion on notice pursuant to CPLR 2201 returnable in Supreme Court (see Rhodes v Mosher, 115 AD2d 351, 351 [4th Dept 1985]; Schwartz v New York City Hous. Auth., 219 AD2d 47, 48 [2d Dept 1996]), and
