Defendants-appellants having moved upon the return of an order to show cause signed by the Honorable Stephen K. Lindley on December 31, 2025, for a stay of enforcement of an order of the Supreme Court, Monroe County, entered December 2, 2025, pending the hearing and determination of the appeal taken herein,
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks a stay of enforcement of the trial court's December 2, 2025 order which directs the defendants-appellants to respond to demand Nos. 13, 14, and 15 in the plaintiff-respondents' third notice to produce is granted on the condition that the appeal is perfected on or before February 9, 2026, and
It is further ORDERED that if the appeal so perfected by February 9, 2026, respondents' brief shall be filed and served on or before March 2, 2026, and the appeal shall be added to the term of this Court commencing May 11, 2026.
