Mental Hygiene Legal Service, having moved for assignment of appellate counsel other than Mental Hygiene Legal Service on the appeal taken herein from an order of the Supreme Court, Oneida County, entered October 17, 2025, and for other relief,
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that motion insofar as it seeks assignment of appellate counsel other than Mental Hygiene Legal Service is denied, and
It is further ORDERED that the motion insofar as it seeks for permission to proceed with a waiver of costs, fees, and expenses is granted, and
It is further ORDERED that the motion insofar as it seeks a transcript without having to pay a fee is granted to the extent that the Oneida County Clerk is hereby directed to provide Mental Hygiene Legal Service with copies of all papers and transcripts of stenographic, digitally recorded, or audiotaped minutes, if any, of the proceedings upon which the appeal is based, and
It is further ORDERED that the appeal herein must be perfected by electronic filing pursuant to 22 NYCRR 1245 and 22 NYCRR 1000.17, and
It is further ORDERED that the motion insofar as it seeks to seal the record and papers filed on this appeal is granted, and
It is further ORDERED that the motion insofar as it seeks to proceed anonymously is granted.
Memorandum: Even assuming, arguendo, that the potential conflict of interest raised in the motion required disqualification of every attorney who works for Mental Hygiene Legal Service in each of the separate offices in the Fourth Judicial Department (see generally People v Pica-Torres, 227 AD3d 1127, 1128-1129 [3d Dept 2024]), the assignment of appellate counsel other than Mental Hygiene Legal Service is not available. Mental Hygiene Legal Service has other available remedies including, inter alia, a motion to transfer the matter to Mental Hygiene Legal Service in a different Judicial Department.
