The People of the State of New York, Respondent, v Marcus Alexander, Appellant.

Application by Lisa A. Packard, Esq. on behalf of the appellant to waive costs, fees and expenses and the assignment of counsel pursuant to Criminal Procedure Law § 380.55 (2) on an appeal from a judgment of conviction of the Criminal Court of the City of New York, Kings County, rendered February 25, 2024.

Upon the papers filed in support of the application and no papers having been filed in opposition thereto, it is

ORDERED that the application is denied as moot.

The appeal was withdrawn by application of appellant in a Decision & Order on Motion issued herewith.
