DECISION & ORDER ON MOTION

2025-1015 K CR
The People of the State of New York, Respondent, v Marcus Alexander, Appellant.

Appeal from a judgment of conviction of the Criminal Court of the City of New York, Kings County, rendered February 25, 2025.

In a Decision and Order on Application dated September 22, 2025, on the court's own motion, the parties were directed to show cause why the appeal should or should not be dismissed on the ground that the appellant is not aggrieved by the judgment of conviction, by filing an affirmation or affidavit on that issue, with proof of service thereof, on or before October 10, 2025. In response to the order to show cause, The Legal Aid Society averred that the notice of appeal was filed in error and they sought to withdraw the appeal.

Upon the order to show cause dated September 22, 2025, and the papers filed in response thereto, it is

ORDERED that the court's own motion to dismiss the appeal is denied; and it is further,

ORDERED that application to withdraw the appeal is granted.
