ORDER TO SHOW CAUSE

2025-02623

Oleg Dei, et al., appellants, v Joshua E. Ryan,

etc., et al., respondents.

(Index No. 619401/2018)

Appeal from an order of the Supreme Court, Suffolk County, dated November 12, 2024, and an order and judgement (one paper) of the same court dated January 14, 2025. Motion by the appellants to extend the time to perfect the appeals.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that on the Court's own motion, the appeal from the order is dismissed on the ground that no appeal lies from an order issued upon the default of the appealing parties (see CPLR 5511); and it is further,

ORDERED that the branch of the motion which is to extend the time to perfect the appeal from the order is denied as academic; and it is further,

ORDERED that on the Court's own motion the parties are directed to show cause why the appeal from the order and judgment should or should not be dismissed on the ground that the appellants are not aggrieved by the order and judgment and/or that no appeal lies from an order and judgment issued upon the default of the appealing parties (see CPLR 5511), by serving and filing, via NYSCEF, a digital copy of an affirmation or an affidavit on that issue on or before March 2, 2026; and it is further,

ORDERED that the branch of appellants' motion which is to extend the time to perfect the appeal from the order and judgment is held in abeyance in the interim; and it is further,

ORDERED that the Clerk of this Court, or his designee, is directed to serve a copy of this order to show cause upon counsel by uploading a copy of this order to show cause to the NYSCEF system.

GENOVESI, J.P., FORD, LANDICINO and QUIRK, JJ., concur.
