G.S. Serv. Sta., Inc. v East Broadway Corp.
It is Ordered that the motion of the respondents-undertenants seeking an order staying the enforcement of the final judgment and warrant of eviction pending the determination of their appeal is granted on condition that the respondents-undertenants: (1) perfect their appeal on or before the May 2026 term, the filing deadline for which is March 11, 2026. Respondent's briefs are to be filed on or before April 1, 2026; reply briefs, if any are due on April 10, 2026; (2) pay ongoing use and occupancy to the petitioner-landlord in the amounts reserved in the most recent lease agreement, on or before the specified rental due date.
In the event the respondents-undertenants fail to comply with the foregoing conditions, the petitioner-landlord may move, on five days notice, for an order vacating the stay.
