Appeals from two orders of the Supreme Court, Nassau County, both dated January 21, 2025. Motion by the appellants County of Nassau, Department of Assessment, County Executive, County Treasurer, Office of Legislature, and Jeannine C. Driscoll, to consolidate the appeals and to extend the time to perfect the appeal under Appellate Division Docket No. 2025-03124.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is to consolidate the appeals is denied; and it is further,
ORDERED that the branch of the motion which is to extend the time to perfect the appeal under Appellate Division Docket No. 2025-03124 is granted, and on or before March 6, 2026, the appellants County of Nassau, Department of Assessment, County Executive, County Treasurer, Office of Legislature, and Jeannine C. Driscoll shall serve and file the record or appendix and their appellants' brief under Appellate Division Docket No. 2025-03124 via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the record or appendix and their appellants' brief under Appellate Division Docket No. 2025-03124 and upload digital copies of the record or appendix and their appellants' brief under Appellate Division Docket No. 2025-03124, with proof of service thereof, through the digital portal on this Court's website; and it is further,
ORDERED that on the Court's own motion the parties to the appeal under Appellate Division Docket No. 2025-03126 are directed to show cause why the appeal under Appellate Division Docket No. 2025-03126 should or should not be dismissed on the ground that no appeal lies from an unsigned order (see CPLR 2219; 5701) and/or on the ground that no appeal lies as of right from a nonfinal order in a proceeding pursuant to CPLR article 78 (see CPLR 5701[b][1]), by serving and filing, via NYSCEF, a digital copy of an affirmation or an affidavit on that issue on or before March 6, 2026; and it is further,
ORDERED that the Clerk of the Court, or his designee, shall serve a copy of this order to show cause upon the parties to the appeals by uploading a copy of this order to show cause to the NYSCEF system.
