DECISION & ORDER ON MOTION

Appeal from an order of the Supreme Court, Nassau County, dated October 28, 2019. Motion by the respondent, inter alia, in effect, to dismiss the appeal pursuant to CPLR 1021 for failure to timely substitute a personal representative for the deceased respondent Robert K. Hickman.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is to dismiss the appeal pursuant to CPLR 1021 for failure to timely substitute a personal representative for the deceased respondent Robert K. Hickman, is granted, and the appeal is dismissed (see CPLR 1021), without costs or disbursements; and it is further,

ORDERED that the motion is otherwise denied as academic.
