DECISION & ORDER ON MOTION

The People of the State of New York, Respondent, v Sean O'Donnell, Appellant.

Motion by appellant to "vacat[e] any automatic dismissal of the defendant-appellant's appeal and reinstating said appeal" from a judgment of conviction of the Justice Court of the Town of Fishkill, Dutchess County, rendered December 4, 2024 and for a 30-day extension of time to perfect the appeal.

Upon the papers filed in support of the motions and no papers having been filed in opposition thereto, it is

ORDERED, that the branch of the motion seeking to vacate any dismissal of this appeal is denied as moot; and it is further,

ORDERED, that the branch of the motion seeking an extension of time to perfect the appeal is granted and the appeal shall be perfected on or before March 6, 2026; and it is further,

ORDERED that, in the event the appeal is not perfected by March 6, 2026, the court, on its own motion, may dismiss the appeal, or respondent may move, on three days' notice, to dismiss the appeal, and may, if appellant is unrepresented, serve such motion upon appellant in person.
