DECISION & ORDER ON MOTION

Appeal from a judgment of the Supreme Court, Suffolk County, dated July 14, 2022. Motion by Tabat, Cohen, Blum, Yovino & Diesa, P.C., in effect, to stay the appeal due to the death of the respondent, and for an extension of time to file a respondent's brief.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is to stay the appeal is denied as unnecessary (see CPLR 1015); and it is further,

ORDERED that the branch of the motion which is for an extension of time to file a respondent's brief is dismissed as having been made in violation of the stay that arose upon the respondent's death.
