Appeal and cross-appeal from a decision of the Supreme Court, Westchester County, dated December 8, 2025, and appeal from a judgment of the same court dated January 27, 2026.
On the Court's own motion, it is
ORDERED that the cross-appeal from the decision is dismissed, without costs or disbursements, on the ground that no appeal lies from a decision (see Schicchi v J.A. Green Constr. Co., 100 AD2d 509); and it is further,
ORDERED that the notice appeal from the decision is deemed to be a premature notice of cross-appeal from the judgment (see CPLR 5520[c]), and the cross-appeal from the judgment will be prosecuted under Appellate Division Docket No. 2026-01256, and not under Appellate Division Docket No. 2026-00156.
