Appeal from an order of the Supreme Court, Nassau County, dated June 10, 2025, which was deemed dismissed pursuant to 22 NYCRR 1250.10(a). Motion by the appellant to stay enforcement of an order and judgment (one paper) of the same court dated July 10, 2025, pending hearing and determination of the appeal. Motion by the respondent to dismiss the appeal on the ground that no appeal lies from an order entered upon the default of the appealing party.
Upon the papers filed in support of the motion by the appellant and the papers filed in opposition thereto, and upon the papers filed in support of the motion by the respondent and no papers having been filed in opposition or relation thereto, it is
