DECISION & ORDER ON MOTION

Appeal from a judgment of the Supreme Court, Nassau County, rendered August 6, 2013. Motion by the respondent to dismiss the appeal on the ground that the appellant has abandoned the appeal. Motion by the appellant to extend the time to perfect the appeal.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is

ORDERED that the motion by the respondent is granted and the appeal is dismissed on the ground that the appellant has abandoned the appeal; and it is further,

ORDERED that the motion by the appellant is denied as academic.
