Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that the notice of appeal filed in the Genesee County Clerk's Office on September 4, 2025, which lists the indictment number as 70584-23 and the conviction date as January 14, 2025, shall be treated as valid as to indictment number 70584-23/001 and the conviction date of February 24, 2025, pursuant to CPL 460.10 (6), and
It is further ORDERED that the motion is granted, and the notice of appeal dated February 25, 2025, is deemed timely filed and served.
