DECISION & ORDER ON MOTION

Appeal from an order of the Supreme Court, Kings County, dated March 29, 2021, which was determined by decision and order of this Court dated May 17, 2023. Motion by the respondent to reargue the appeal or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this Court. Separate motion by the respondent to stay enforcement of the decision and order of this Court dated May 17, 2023, pending hearing and determination of the motion to reargue the appeal.

Upon the papers filed in support of the motion to reargue the appeal and no papers having been filed in opposition or relation thereto, and upon the papers filed in support of the motion to stay enforcement of the decision and order of this Court and the papers filed in opposition thereto, it is

ORDERED that the motion by the respondent to reargue the appeal or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this Court is denied; and it is further,

ORDERED that the motion to stay enforcement of the decision and order of this Court dated May 17, 2023, pending hearing and determination of the motion to reargue the appeal, is denied as academic.
