| DECISION & ORDER ON MOTION |
Appeal from a judgment of the County Court, Dutchess County, rendered March 8, 2023. By decision and order on motion of this Court dated May 23, 2025, the motion of the appellant pro se for leave to serve and file a supplemental brief was granted. Motion by the appellant to hold the appeal in abeyance pending the determination of a motion to vacate the judgment pending before the Supreme Court, Dutchess County.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion by the appellant is denied; and it is further,
ORDERED that on the Court's own motion the decision and order on motion of this Court dated May 23, 2025, is recalled and vacated, and the motion for leave to serve and file a pro se supplemental brief is denied.
The appellant has failed to file a pro se supplemental brief although afforded sufficient opportunity to do so.
