2026-01581 In the Matter of Clare Kleese, respondent, v Robert Lazazzaro, appellant. (Docket No. O-14281-2025)
| DECISION & ORDER ON MOTION |
Appeal from an order of the Family Court, Suffolk County, dated January 8, 2026. Motion by the appellant to stay all proceedings in the above-entitled matter, pending hearing and determination of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that on the Court's own motion, the appeal is dismissed, without costs or disbursements, on the ground that no appeal lies as of right from a nondispositional order in a proceeding pursuant to Family Court Act article 8 (see Family Ct Act § 1112), and we decline to grant leave to appeal; and it is further,
ORDERED that the motion is denied as academic.
CONNOLLY, J.P., TAYLOR, QUIRK and GOLDBERG VELAZQUEZ, JJ., concur.
