DECISION & ORDER ON MOTION

Appeal from an order of the Supreme Court, Suffolk County, dated August 17, 2020. Motion by the appellant Susan M. Arrigo, to substitute Susan M. Arrigo, as the administrator of the estate of Michael E. Arrigo, for the deceased appellant Michael E. Arrigo, to amend the caption accordingly, and to vacate the stay that arose upon the death of the appellant Michael E. Arrigo. Separate motion by the appellant Susan M. Arrigo to re-calendar the appeal for oral argument.

Upon the papers filed in support of the motion to substitute Susan M. Arrigo, as the administrator of the estate of Michael E. Arrigo, for the deceased appellant Michael E. Arrigo, to amend the caption accordingly, and to vacate the stay that arose upon the death of the appellant Michael E. Arrigo, and no papers having been filed in opposition or in relation thereto, and upon the papers filed in support of the motion to re-calendar the appeal for oral argument and the papers filed in opposition thereto, it is

ORDERED that the motion to substitute Susan M. Arrigo, as the administrator of the estate of Michael E. Arrigo, for the deceased appellant Michael E. Arrigo, to amend the caption accordingly, and to vacate the stay that arose upon the death of the appellant Michael E. Arrigo, is granted, Susan M. Arrigo, as the administrator of the estate of Michael E. Arrigo, is substituted for the deceased respondent Michael E. Arrigo, the caption is amended accordingly, and the stay which arose upon the death of the deceased respondent Michael E. Arrigo, is vacated; and it is further,

ORDERED that the motion which is to re-calendar the appeal for oral argument is denied.
