Appeal from an order of the Family Court, Dutchess County, dated August 28, 2024. Motion by the respondent, inter alia, in effect, to dismiss the appeal on the ground that it has been rendered academic by the adoption of the subject children.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is to dismiss the appeal is granted, and the appeal is dismissed, without costs or disbursements (see Matter of Hailey ZZ. [Ricky ZZ.], 19 NY3d 422, 426); and it is further,
ORDERED that the motion is otherwise denied as academic.
