| DECISION & ORDER ON MOTION |
Appeal from a clerk's extract of the minutes of a jury verdict of the Supreme Court, Kings County, dated April 25, 2023, which was dismissed by decision and order on motion of this Court dated June 26, 2024, on the ground that no appeal lies from a clerk's extract of the minutes of a jury verdict (see CPLR 5512[a]); Rockman v Brosman, 280 AD2d 951). Motion by the appellant, inter alia, to vacate the decision and order on motion of this Court dated June 26, 2024, or, in effect, in the alternative, for leave to appeal from the clerk's extract of the minutes of a jury verdict, and for an extension of time to perfect the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branches of the motion which are to vacate the decision and order on motion of this Court dated June 24, 2024, or, in effect, in the alternative, for leave to appeal from the clerk's extract of the minutes of a jury verdict, are denied; and it is further,
ORDERED that the motion is otherwise denied as academic.
