It is hereby ORDERED that the motion for permission to proceed with a waiver of costs, fees, and expenses is granted, and,
It is further ORDERED that the motion insofar as its seeks assignment of counsel is granted, andJames Egan, Esq., 45 Exchange Blvd., 4th Floor, Rochester, New York 14614 is hereby assigned as appellant's counsel for the purposes of this appeal, and
It is further ORDERED that the motion insofar as seeking to vacate the dismissal of the appeal is granted on the condition that the appeal is perfected on or before May 1, 2026, and
It is further ORDERED that the motion insofar as it seeks a transcript without having to pay a fee is granted to the extent that the Oneida County Clerk is hereby directed to provide James Egan, Esq. with copies of all papers and transcripts of stenographic, digitally recorded, or audiotaped minutes, if any, of the proceedings upon which the appeal is based, and
