| ORDER TO SHOW CAUSE |
2025-15009
Star221, LLC, respondent, v Jodi Kilbride,
appellant, et al., defendants.
(Index No. 613843/2024)
Appeals from an amended order of the Supreme Court, Nassau County, dated June 16, 2025, and an order of the same court dated October 22, 2025. Motion by the appellant to deem the notice of appeal from the amended order to reflect that the appeal is taken from a decision and order of the same court dated June 16, 2025, and not from the amended order of the same date.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that on the Court's own motion, the parties to the appeals are directed to show cause before this Court why an order should not be made and entered dismissing the appeals on the ground that the right of direct appeal from the orders terminated upon entry in the above-entitled action of a judgment of the same court dated October 22, 2025 (see Matter of Aho, 39 NY2d 241), by uploading a digital copy of an affirmation or affidavit on that issue, with proof of service thereof, through the digital portal on this Court's website on or before April 20, 2026; and it is further,
ORDERED that the motion by the appellant is held in abeyance in the interim; and it is further,
ORDERED that the Clerk of the Court, or his designee, shall serve a copy of this order to show cause upon the parties or their attorneys, via email to the email address provided to this Court, or if no email address is available for service by regular mail.
DILLON, J.P., BRATHWAITE NELSON, LOVE and MCCORMACK, JJ., concur.
