ORDER TO SHOW CAUSE

Appeal from an order of the Supreme Court, Kings County, dated March 7, 2024. The appellants perfected the appeal on August 8, 2024. On May 19, 2025, the appellants submitted an application to withdraw the appeal based upon the issuance of an order of the Supreme Court, Kings County, dated April 24, 2025, which the appellants contended rendered the appeal academic. The application was rejected and all counsel were instructed that the appeal could not be withdrawn until a pending motion by the respondent to extend the time to file a brief was withdrawn or determined. The motion was not withdrawn and was determined in a decision and order on motion of this Court dated December 19, 2025. The respondent filed a brief on January 20, 2026, and the appellants filed a reply brief on January 30, 2026. Counsel for the parties did not respond to a status inquiry from this Court on January 19, 2026. The matter was placed on the calendar for March 23, 2026. On March 19, 2026, the parties submitted a stipulation withdrawing the appeal.

Now, on the Court's own motion, it is

ORDERED that Farrell Fritz, P.C., counsel for appellants, and Munzer & Saunders, LLP, counsel for respondents, are directed to show cause before this Court why an order should or should not be made and entered imposing such sanctions and/or costs, if any, against them pursuant to 22 NYCRR 1250.2(c) as this Court may deem appropriate, by serving and filing, via NYSCEF, a digital copy of an affirmation or an affidavit on that issue on or before April 27, 2026; and it is further,

ORDERED that the Clerk of this Court, or his designee, is directed to serve a copy of this order to show cause upon counsel by uploading a copy of this order to show cause to the NYSCEF system.
