DECISION

On the court's own motion, motion by appellant-respondent Frank Corigliano Contractors Inc., motion by appellant-respondent Aldo Iron Works, Inc. and cross motion by respondent Fowler are consolidated for purposes of disposition.

That branch of the motion by appellant/respondent Frank Corigliano Contractors, Inc. to enlarge time to perfect appeal is granted on condition that appeal be perfected by August 1, 2005; otherwise, said branch of motion denied. The remaining parties, if so advised, may serve and file a respondent's brief within 21 days of the date of filing of the appellant's brief.

That branch of the motion by appellant/respondent Frank Corigliano Contractors, Inc. seeking an extension of time to submit a respondent's brief is granted, and said brief shall be served and filed within 21 days of the date of the order hereon. The remaining parties, if so advised, may serve and file a reply brief within 14 days of the date of filing of said respondent's brief.

Motion by appellant/respondent Aldo Iron Works, Inc. for a stay of trial pending determination of appeals is granted.

Cross motion by respondent Fowler to sever the third-party actions denied.
