DECISION
That branch of the motion by tenant-appellant seeking to be restored to possession of the premises pending determination of the appeal is granted. Landlord-respondent is directed to restore tenant-appellant to possession forthwith. Re-execution of the warrant is stayed on condition that within 10 days of the date of the order herein tenant-appellant pay landlord-respondent any and all arrears in her share of the rent and continue to pay her share of the rent as same becomes due. Upon default, landlord-respondent may move upon three days' notice to vacate the stay. Tenant-appellant is directed to perfect the appeal by September 2, 2005; otherwise stay vacated. The funds on deposit in the court below may be released to landlord-respondent.
