DECISION
Motion by tenants-appellants for a stay pending appeal is granted on condition that if (1) the check(s) issued are made out to the Finance Administrator, tenants shall within 10 days from the date of the order hereon deposit with the court below the sum of $3,150; or if (2) the check(s) issued are made out to landlord, tenants is directed to pay landlord $3,150. Tenants shall pay to landlord any and all arrears in rent and/or use and occupancy at the rate previously payable as rent within 10 days from the date of this order and continue to pay landlord use and occupancy at a like rate as it becomes due. Upon failure of tenants to make a required payment, landlord may move upon 3 days' notice to vacate the stay. Tenants shall perfect the appeal by November 4, 2004; otherwise stay vacated without further order of this court. If tenants deposits $3,150 with the court below, tenants shall file with this court proof of deposit within one business day after such deposit.
