It is Ordered that the motion is granted on the condition that : (1) appellant pays the balance due on the judgment [ $3,285.10 ], on or before October 31, 2005; (2) appellant continues to pay monthly use and occupancy at the rate of $657.02 per month, along with an additional $500.00 each month towards the arrears outstanding, without prejudice; and (3) appellant perfects the appeal by no later than the February 2006 term of this court - the filing deadline is December 14, 2005. In the event that appellant fails to comply with any of the aforementioned conditions, petitioner- landlord may move on five (5) days' notice to vacate the stay.
