It is Ordered that the motion for a stay is granted on the condition that the appellant pays monthly use and occupancy by the 7th of each month, without prejudice, and that the appellant perfects the appeal by the March 2006 term of this court. In the event tenant fails to comply with either of the aforementioned conditions, the petitioner-landlord may move on five (5) days' notice to vacate the stay.
