The Appellant shall file, in duplicate, with proof of service, with the Clerk of this Court, copies of the Pre-Argument Statement, pursuant to § 600.17 of the Rules of the Appellate Division- First Department, and two (2) copies of the order granting leave to appeal. The stay is continued, to and including February 28, 2006, on condition that the appellant, on each subsequent rental due date, continues to pay for accruing use and occupancy at the rate previously payable as rent, without prejudice to either parties' rights.

The Court notes that there is no stay in effect at this time. By prior order of this Court, the warrant of eviction was stayed only through November 9, 2005, to afford the appellant additional time to finally perfect the appeal.
