It is Ordered that the motion to dismiss the appeal is denied, without prejudice to raising the issue of the appealability of the order in the respondent's answering brief on the appeal. The cross-motion for a stay of the proceeding in the trial court is denied, without prejudice to renew after the appeal has been perfected. The Court notes that the Notice of Appeal was filed almost six (6) months ago and the appeal has yet to be perfected.

It is Ordered that the motion is denied, without prejudice to renew upon timely service of the moving papers on the adversary. The Court notes that the November 15, 2005 order of this Court incorrectly stated that the appellant had failed to tender $2,000.oo to the petitioner, as required by an interim order of this Court. Accordingly, on the Court's own motion, the execution of the warrant of eviction is stayed, to and including December 14, 2005, to afford the appellant an opportunity to tender the remaining arrears to the petitioner, without prejudice. If tendered, the appellant must move for a further stay of the execution of the warrant.

It is Ordered that the motion to vacate the stay is denied. The cross-motion is granted to the extent of enlarging the time to perfect the appeal to the March 2006 term of this court, the filing date for which is January 11, 2006. The prior orders of this court are modified accordingly.
