It is Ordered that the motion and cross-motion are consolidated for the purpose of disposition. The stay is continued, to and including March 9, 2006. If, by said date, the appellants have: - tendered $31,381.40 - due pursuant to the prior order of this Court, along with the accruing maintenance [at $4,092.07 per month ] due for January, February and March 2006, to the petitioner-landlord, without prejudice ;and - perfected the appeal, then the appellants may move for a further extension of the stay. Otherwise, the warrant of eviction may be enforced after March 9, 2006. The funds on deposit with the Clerk of the Civil Court are to remain there until further order of this Court or the trial court.
