It is Ordered that the motion for a stay is granted on condition that the appellant perfects the appeal by the October 2005 term - the filing deadline is August 10, 2005. In the event of appellant's failure to comply with the foregoing condition, respondents may move on five days' notice for an order vacating the stay.

It is Ordered that the motion and cross-motion are consolidated for the purpose of disposition. The stay is continued to and including August 11, 2005. Thereafter, the warrant of eviction may be enforced. If, prior to said date, the appeal has been perfected and the appellant has paid the May through August 2005 use and occupancy, along with all charges due for utilities, then the appellant may move for a further continuation of the stay, to and including September 30, 2005. The Court notes that the issue on appeal is whether the lease was extended to September 30, 2005. Accordingly, no stay will be granted beyond that date.
