APPELLATE TERM, SUPREME COURT: FIRST DEPARTMENT MOTIONS
The following orders on motion were filed and entered on June 6, 2005

It is Ordered that the motion is granted only to the extent of staying the execution of the warrant of eviction on condition that: (1) appellant perfects its appeal for the September 2005 term of this court - filing deadline is July 7, 2005; (2 ) on or before June 15, 2005, pays the additional $7,000.00 due on the judgment, along with the June use and occupancy, to the petitioner, without prejudice; and (3) continues to pay for accruing use and occupancy, at $2,800.00 per month, without prejudice to petitioner moving in the trial court for market value use and occupancy. In the event the appellant fails to comply with any of the aforementioned conditions, the petitioner may move on five (5) days' notice for an order vacating the stay. In the event the petitioner's exhibits are not provided to the respondent-appellant's attorney by June 30, 2005, the record on appeal may be submitted without those exhibits.

It is Ordered that the motion to strike the record, dismiss the appeal and for other relief is denied.

It is Ordered that the motion to supplement the record with the appellant's two (2) exhibits is denied as moot. The exhibits annexed to the moving papers have been duplicated and will be submitted to the September 2005 term panel that will be reviewing this appeal.
