It is Ordered that the motion for a stay is denied, without prejudice to renew after the appellant has provided the petitioner-landlord access to inspect the apartment. The denial herein is also without prejudice to pursuing an Article 78 proceeding of the administrative determination of the New York City Department of Housing Preservation and Development, if so advised.

It is Ordered that the motion for a stay is granted on condition that appellant: 1) on or before July 18, 2005, pays any arrears outstanding to the petitioner, without prejudice; 2) continues to pay for accruing use and occupancy on each subsequent rental due date, without prejudice; and 3) perfects the appeal by no later than the October 2005 term. In the event of appellant's failure to comply with the foregoing conditions, petitioner may move on five days' notice for an order vacating the stay.

In the event of appellant's failure to comply with the orders of this Court, petitioner may move on five days' notice for an order vacating the stay. No further extension of time will be granted in this narcotics eviction proceeding.
