It is Ordered that the motion for a stay is granted on condition that the appellant: 1- on or before July 29, 2005, pays the balance due petitioner on the November 23, 2004 Civil Court order/judgment [ $3,325.00 ], without prejudice; 2 - on or before August 25, 2005, pays the December 2004, to and including the August 2005, use and occupancy that has accrued to the petitioner, without prejudice [ 9 months @ $700 each = $6,300.00] ; 3- continues to pay for use and occupancy, on each subsequent rental due date, at the rate of $700 per month, without prejudice; and 4- perfects the appeal by the November 2005 term - the filing deadline is September 14, 2005. Upon the failure of appellant to comply with any of the foregoing conditions, petitioner-respondent may move on five days' notice for an order vacating the stay
