It is Ordered that the motion seeking to continue the stay is granted and appellant is directed to perfect its appeal for the October 2005 term, as per the July 6, 2005 order of this Court. In the event of appellant's failure to tender accruing use and occupancy to the petitioner on each subsequent rental due date, or, in the event the appeal is not perfected by the October 2005 term, petitioner may move on five days' notice for an order vacating the stay.
