It is Ordered that the motion to dismiss the defendant's appeal is granted unless it is perfected by no later than the December 2005 term - the filing deadline is October 11, 2005. The plaintiff's time to perfect its own appeal is also enlarged to the December 2005 term. The parties should make arrangement to prepare a joint record on appeal. The prior order of this court is modified accordingly.
